TERMS OF SERVICE

These Terms apply to the NextRound website and mobile app (collectively, “NextRound”), operated by Next Round GbR, Schellingstraße 15, 07548 Gera, Germany, email: nextround67@gmail.com.

By using the App, you agree to these Terms. If you do not agree, you may not use the App.

NextRound is a party and games app featuring multiplayer lobbies, Would You Rather questions, quizzes, an impostor mode, feedback features, player settings, and optional Premium features.

The App is intended for entertainment. There is no entitlement to specific features, content, or uninterrupted availability.

The App contains party-game content. Some modes or categories may include drinking-game elements, explicit or offensive material, or other adult content.

The App may be used by people aged 16 or older.

The App does not encourage alcohol consumption. All drinking tasks are voluntary and may be refused or replaced with non-alcoholic alternatives.

• Drink responsibly.
• Never drive under the influence of alcohol or drugs.
• Respect every player’s boundaries.
• Never pressure anyone to drink or complete a task.
• Stop playing if anyone feels uncomfortable.

Users play at their own risk. The operator is not responsible for consequences caused by excessive alcohol consumption, risky behavior, or disregarding personal boundaries.

You must not misuse the App.

• Insults, harassment, or threats
• Hate speech, discrimination, or racist content
• Extremeist, glorifying-violence, or unlawful content
• Spam, advertising, or unauthorized commercial use
• Manipulating, disrupting, or overloading the App
• Circumventing security measures
• Using the App for unlawful purposes

The operator may remove prohibited content, restrict features, or exclude users who violate these Terms.

Users may voluntarily submit feedback and remain responsible for what they submit. Content must not violate third-party rights, the law, or these Terms.

By submitting feedback, you allow the operator to review and use it to improve the App. There is no entitlement to implementation.

Creating or joining a lobby requires processing player names, lobby codes, temporary session data, and game data for synchronization and gameplay. The operator does not guarantee that all technical data is immediately deleted when a game ends.

The operator is not responsible for other players’ conduct. Users decide whom they invite and which lobbies they join.

Premium features are optional. The same prices apply to the website and mobile app: €5.99 per week or €29.99 per year, including VAT. Prices are displayed before purchase.

Where a free trial is offered, the duration and conditions are displayed before purchase. Unless cancelled in accordance with the applicable terms, a subscription renews automatically at the displayed price.

Website subscriptions are processed via Stripe. A subscriber can cancel through the Stripe customer portal accessed via the “Cancel subscription” function in the app or the corresponding link provided by NextRound. The operator does not store complete payment-card data and stores only the subscription or Premium status needed to provide the service.

Statutory cancellation and withdrawal rights remain unaffected.

The operator aims to provide reliable service but does not guarantee uninterrupted availability.

The App, game modes, categories, content, or features may be changed, restricted, expanded, or discontinued for technical, economic, legal, or security reasons.

App content, designs, graphics, logos, brands, categories, questions, and other elements are protected by copyright or other laws.

Copying, publishing, distributing, modifying, or commercially using them outside the App requires prior written consent. The App is for private entertainment only.

Information about personal-data processing is provided in the App’s Privacy Policy.

The operator has unlimited liability for intent, gross negligence, and injury to life, body, or health.

For ordinary negligence, liability applies only to essential contractual duties and is limited to foreseeable, typical loss. Further liability is excluded where legally permitted.

The operator is not liable for harm caused by improper use, irresponsible alcohol consumption, disregarding others’ boundaries, or unlawful conduct.

Names, feedback, and other user-submitted content are not the operator’s own content. The operator may review and remove such content where appropriate or legally required.

Users may be temporarily or permanently excluded for violating these Terms, applicable law, or third-party rights, including misuse, criminal content, manipulation, harassment, or underage use.

These Terms may be updated for legal, technical, or organizational reasons. The current version will be available in the App or through a provided link.

Users will be informed appropriately of material changes. Continued use after changes take effect constitutes acceptance where legally permitted.

The law of the Federal Republic of Germany applies. Mandatory consumer-protection rules in a consumer’s country of habitual residence remain unaffected.
